Wohnsitz und gewöhnlicher Aufenthalt im Ausland
Wohnt der Elternteil nicht in Deutschland und hält er sich hier auch nicht gewöhnlich auf, bekommt er Kindergeld nach dem Einkommensteuergesetz (EStG) nur, wenn er

nach § 1 Absatz 2 EStG unbeschränkt einkommensteuerpflichtig ist oder
nach § 1 Absatz 3 EStG als unbeschränkt einkommensteuerpflichtig behandelt wird.
Ob die Voraussetzungen des § 1 Absatz 2 oder Absatz 3 EStG für die unbeschränkte Steuerpflicht vorliegen, entscheidet das Finanzamt. An dessen Feststellungen sind die Familienkassen grundsätzlich gebunden.

Wohnt der Elternteil nicht in Deutschland und ist er hier auch nicht unbeschränkt einkommensteuerpflichtig, kann Kindergeld nach dem Bundeskindergeldgesetz bestehen. Nähere Informationen erteilt Ihnen Ihre Familienkassse.
